Federal Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The situation originates in a erroneous deportation to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to face human smuggling allegations, he was held in federal custody.
In her decision, the court noted that the government lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
